摘要
近年来,我国共享经济不断发展,从业人员持续增加,共享经济用工关系呈现出显著的特征,比如用工形态灵活多样、从业者特别是服务提供者的从属性有所减弱、对网络平台的依赖性较强等等。这些特点对共享经济下劳动关系的认定带来了冲击,主要表现在服务提供者与网络平台劳动关系的认定率很低、相似案件的司法实践认定结果并不统一、配送外包公司的出现使劳动关系的认定更加困难等等。本文对这些特点和冲击进行了深入剖析,并提出了相应的法律规制建议。
In recent years,the sharing economy in China has been developing and the number of employees has been increasing,and the labor relations in the sharing economy have shown significant characteristics,such as flexible and diverse employment forms,weakening of the subordination of the employees,especially the service pro⁃viders,and strong dependence on the network platform.These characteristics have brought impacts on the identifica⁃tion of labor relations in the sharing economy,mainly the low rate of identification of labor relations between service providers and network platforms,the inconsistent results of judicial practice identification in similar cases,and the emergence of delivery outsourcing companies,which makes the identification of labor relations more difficult and so on.This paper makes an in-depth analysis of these characteristics and impacts,and puts forward corresponding sug⁃gestions for legal regulation.
