“强制猥亵、侮辱罪”倾向犯之否定

On the Negation of Sexual Tendency to the crime of Compulsory Molest or Humiliate

主张"强制猥亵、侮辱罪"属于倾向犯的观点以"主客观相统一""主观违法"为理论依据,以犯罪类型的区分为现实需要。但"主客观相统一"是对行为人罪过与认识能力的要求,不苛求犯罪目的与法益类型相一致。"追究性刺激、满足性需要"的动机与其他犯罪目的在价值上没有明显区别,不能作为违法性评价的依据。运用犯罪客体、犯罪客观方面等外在的、定型的标准足以区分"强制猥亵、侮辱罪"与普通"侮辱罪"以及"猥亵""侮辱"两种行为。因此,将"强制猥亵、侮辱罪"定性为倾向犯没有学理上的依据,也没有实践中的必要。

There is an academic opinion that the crime of compulsory molest or humiliate is a sexual tendency crime.This opinion is based on the theory of"the consistency between subjectivity and objectivity"and"the subjective violation of law",and the demand for classificatiing different types of crime.But the unification of subjectivity and objectivity just requir the perpetrator’s delinquency and cognitive ability,not requir that the purpose of the crime be consistent with the type of legal interests.There is no obvious difference between the two purposes of Compulsory Molest or Humiliate,so the two purposes can not be used as the basis for the evaluation of illegality.In addition,it is sufficient to distinguish"compulsory molest or humiliate"from"ordinary humiliate"and"molest"from"humiliate"by using external and stereotype criteria such as the object of crime and the objective aspect of crime.Therefore,there is no theoretical basis and no practical necessity to classify the crime as a sexual tendency crime.
