摘要
新生代农民工是我国农民工的主体,随着城镇化的不断推进,新生代农民工的就业权益问题日益突出。从体面劳动的视角出发,分析新生代农民工就业权益的本质属性,发现新生代农民工的就业权益存在缺乏针对性的法律法规、签订无效劳动合同、社会保障水平低等问题,最后提出完善农民工权益保护法、加强对劳动合同的监管、增强新生代农民工的社会保障水平等有效的解决路径。
The new generation of migrant workers is the main body of migrant workers in China.However,with the development of urbanization,the employment rights and interests of the new generation of migrant workers have become increasingly prominent.From the perspective of decent work,the paper analyzed the essential attributes of the employment rights of the new generation of migrant workers,and finds that the problems of employment rights of the new generation migrant workers are lack of targeted laws and regula‐tions,signing of invalid labor contracts and low levels of social security.The effective solution path is to im‐prove the law on the protection of rights and interests of migrant workers,strengthen the supervision of la‐bor contracts and enhance the social security level of the new generation of migrant workers.
