乡村振兴下农民美好生活权利保障析论——农民集体发展权的建构与实现

我国的脱贫攻坚无疑为乡村振兴战略的全面实施提供了坚实基础,但不可否认的是,当前我国农民发展仍面临突出矛盾。所以,为了克服因重个人而轻集体所导致的农民向好发展要求无法在根本上得到满足,有必要建构以农民集体为主体的农民集体发展权,以使农民能够在集体中获得更好发展。而在这一权利谱系中,壮大农村集体经济、提升农村治理效能、解除农民后顾之忧显然就是主要内容。正因如此,纾解壮大农村集体经济制约因素、促进农村"三治"有机结合、优化"后脱贫"时代农村社会保障供给自然而然也就成为了农民集体发展权的实现导向,未来我国需要从这三方面着手予以深入推进。

China’s realization of the targets of poverty alleviation has undoubtedly provided a solid foundation for the comprehensive implementation of the rural revitalization strategy.However,it is undeniable that China is still facing outstanding contradictions in farmers’development.To overcome the inability of fundamentally satisfying farmers’demands on good development due to placing the individual over the collective,it is therefore necessary to construct farmers’collective development right with the farmers’collective as the main so that farmers can benefit more in the collective development.The main task is evidently to strengthen the rural collective economy,improve the effect of rural governance and relieve farmers worries about the future.To this end,the orientation for the realization of the farmers’collective development rights should be to remove the restrictive factors in strengthening the rural collective economy,promoting the organic combination of"the three governance ways"(autonomy,rule of law and rule of morality)and optimizing the rural social security supply in the post-poverty-alleviation era.
