摘要
虽然《经济、社会及文化权利国际公约》《儿童权利公约》等国际条约并未明文提及学前教育,但是,依据条约解释规则,仍然可以证明这些国际条约确立了学前儿童受教育权。国际法上的学前儿童受教育权在本质上具有多重属性,包括接受教育的权利、平等受教育的权利、受教育自由的权利以及免受不人道惩戒的权利等内容。依据国际法的规定,我国有义务将相关国际法原则与规则纳入即将制定的《学前教育法》,促进和保护学前儿童受教育权。
Although"International Covenant on Economic,Social and Cultural Rights"and"Convention on the Rights of the Child"do not explicitly mention preschool education,it can still be proved that these international treaties have established the right to the education of preschool children according to the rules of interpretation of the treaties.Preschool children's right to education in international law has multiple attributes in essence,including the right to receive education,the equal right to education,the liberal right to education and the right to be free from inhumane punishment.According to international law,China has the obligation to promote and protect the right to education of preschool children,and brings the relevant rules of international law binding on China into the"Preschool Education Law".
