环境风险视域下企业自我规制研究

Research on Enterprise Self-regulation from Perspective of Environmental Risk

企业自我环境规制是应对环境风险的积极策略。《关于构建现代环境治理体系的指导意见》明确提出健全环境治理企业责任体系,强调深化企业主体作用,实现政府治理和社会调节、企业自治良性互动。在“治理”语境下,环境治理已不是政府单方职责,企业自治也被吸纳成为一种制度性的力量改变着环境治理权力格局和整体结构。本文在对企业自我环境规制进行界定和分析其正当性的基础上,整理了企业自我环境规制在中国的实践,进而提出优化企业自我环境规制的策略。

Enterprise environmental self-regulation is an active strategy to deal with environmental risks.The Guiding Opinions on Building a Modern Environmental Governance System clearly proposes a corporate responsibility system for improving environmental governance,emphasizes the deepening of the main role of enterprises to realize the benign interaction of government governance,social regulation and enterprise autonomy.In the context of"governance",environmental governance is no longer a unilateral governmental responsibility,and corporate autonomy has also been absorbed as an institutional force that changes the power pattern and overall structure of environmental governance.Based on the definition of corporate environmental self-regulation and the analysis of its legitimacy,this paper sorts out the practice of corporate environmental self-regulation in China,and then proposes strategies for optimizing corporate environmental self-regulation.
