此外,短视频的飞速发展对现有著作权保护体系提出了挑战。伴随国内对于知识产权保护的重视程度逐渐加深,著作权法因势迎来了第四次修改,近年来相关的司法实践案例也愈加具备指导意义,判定著作权侵权的关键——合理使用制度在此背景下更具可操作性。为了平衡自由表达和著作权保护、适应国内经济发展新局势,理论上可借鉴四要素检测法作为宏观的支撑,在实践中除加大事后救济力度、确立惩罚性赔偿制度,更应从源头上杜绝间接侵权,增强平台和用户方的责任意识,提倡事前预防措施。此外,还可以引入法经济学的研究思路,与国际发展趋势紧密接轨。

The wave of big data is sweeping across the country.Short videos,as a new form of video,is developing rapidly,but it also poses a challenge to the existing copyright protection system.With the rising awareness of the importance of intellectual property protection in China,the Copyright Law has been amended for the fourth time,and the relevant judicial practice cases have become more and more instructive in recent years;as a result,the fair use system,which is the key to determining copyright infringement,has become more operable in this context.In order to balance free expression and copyright protection and adapt to the new normal situation of domestic economic development,theoretically,the four-element testing method should be used as a macro support.In practice,in addition to increasing post-event relief efforts and formally establishing a punitive compensation system,indirect infringements should be eliminated from the source,the platform and users’sense of responsibility should be enhanced,and short video platforms should be encouraged to take active precautionary measures.Furthermore,the research ideas of law and economics can also be introduced to closely integrate with the development trend of copyrights in the international community.
