建党百年土地法治建设的历史逻辑和基本经验

Historical Logic and Basic Experience in a Century of the Institutional Construction of Land Rule of Law in China

研究目的:从法治角度梳理、分析和总结中国共产党建党百年来我国土地制度变迁的历史逻辑和基本经验。研究方法:历史分析、法律文本分析、法律规范解释。研究结果:中国共产党在新民主主义革命时期建立的“革命型土地法模式”,为国家的独立和统一奠定了坚实基础;在社会主义革命和建设时期探索的“引导型土地法模式”,为国家政权的巩固和国民经济的发展创造了有利条件;在改革开放和社会主义现代化建设时期探索的“改革型土地法模式”,为社会主义焕发青春提供了广阔空间;在新时代中国特色社会主义建设时期构建的“创新型土地法模式”,为推进国家治理体系和治理能力的现代化提供了重要保障。研究结论:百年土地法治建设的基本经验表明,坚持党的领导是根本保障,坚持人民至上是基本立场,坚持理论创新是动力源泉。

The purpose of this study is to clarify,analyze and summarize the historical logic and basic experience in the changes of land institutions in China since the founding of the Communist Party of China in the last hundred years from the perspective of rule of law.The research methods of this study include historical analysis,legal text analysis and the interpretation of legal norm.The results indicate that during the period of the new democratic revolution,the“revolutionary land law model”laid a solid foundation for the independence and unification of China;during the period of socialist revolution and construction,the“inductive land law model”created favorable conditions for the consolidation of regime and the development of the national economy;during the period of reform and opening up and socialist modernization,the“reformation-type land law model”provided a broad space for the rejuvenation of socialism;during the period of socialism with Chinese characteristics in the new era,the“innovative-type land law model”has laid an important guarantee for the modernization of national governance system and governance capacity.In conclusion,for the rule of law in land institutions in China,adhering to the leadership of the Communist Party is the fundamental guarantee;adhering to the“people first”is the basic position of the construction;adhering to the theoretical innovation is the motivation source.
