《中国共产党纪律处分条例》中“等”字的理解

Understanding the Word “Deng” in “the Regulations of the Communist Party of China on Disciplinary Action”

《中国共产党纪律处分条例》含有助词"等"的条款为数较多。当中的"等"字均表示列举未尽,还是列举后煞尾,抑或两种含义兼而有之,已成为党纪处分工作不可忽视的问题。从法理学视角看,在绝大多数条款中,"等"字应表示"列举后煞尾",即"等"字之前没有明文列举的,一般不得计算在内;仅在少数特定条款中,才可"表示列举未尽",即"等"字之前列举的,只是部分,不是全部。

There are many articles including the word “Deng” in the regulations of the Communist Party of China on disciplinary action. Among them, the word “Deng” indicates that the list is not exhaustive, or the end of the list, or both, which has become a problem that can not be ignored in the party discipline work. From the perspective of jurisprudence, in the vast majority of clauses, the word “Deng” should mean “after listing”, that is to say, if the word “Deng” is not explicitly listed before, it should not be counted in general.Only in a few specific clauses, it can “indicate that the listing is not complete”, that is, the word “Deng” is listed in the front, only part, not all.
