宅基地“三权分置”的法理思考

Jurisprudential Thinking on“Separation of Three Rights”of Homestead

宅基地“三权分置”设立的主要目标是实现农民居住和耕地管制的目标。但现行的土地制度仅体现了农民的居住权,农民对土地的财产权没有得到实现。因此需要探索“三权分置”改革的方法路径,落实农民的宅基地所有权,明确宅基地资格权和使用权。通过明晰身份属性和财产属性,划分宅基地使用权的主体和获取方式以及效力范围,利用登记生效主义原则规范宅基地的使用,盘活闲置的农村土地资源,实现富民的目标。

The main goal of establishing“separation of three rights”of homestead is to achieve the goal of farmers living and cultivated land control.However,the current land system only reflects the farmers’right to live,and their property right to land has not been fully realized.Therefore,it is necessary to explore the method of the reform of“separation of three rights”to implement the farmers’homestead ownership and to clarify the homestead qualification right and the use right.Through clarifying the identity attribute and the property attribute,this paper divides the main body of use right of the homestead and the obtaining way as well as the effective scope,standardizes the use of the homestead by using the principle of registration,so as to activate the idle rural land resources and realize the goal of enriching the people.
