Criminal Risks and Countermeasures of Internet Celebrity Economic Development under the Background of Anti-Globalization

逆全球化背景下,传统经济行业遭受严重冲击,依托互联网而生的新型数字化经济模式异军突起,网红经济已成为各国数字化经济新形态。但由于缺乏刑事法治保障,我国网红经济发展中刑事风险丛生:既有市场准入环节中非法经营的风险、运行环节中复合型犯罪风险,也有数据管理环节中个人信息被侵犯的风险。为应对网红经济发展的刑事风险,保障网红经济的健康稳步发展,必须构建刑法应对路径,秉持刑法谦抑理念,审慎刑事立法,灵活司法解释。

Under the background of anti-globalization,traditional economic industries have been severely impacted,and new digital economic models based on the Internet have emerged.The Internet celebrity economy has become a new form of digital economy in various countries.However,due to the lack of criminal legal protection,criminal risks in the development of my country's Internet celebrity economy are numerous:there are risks of illegal operations in the market access link,compound crime risks in the operation link,and the risk of personal information being violated in the data management link.In order to cope with the criminal risks of the economic development of Internet celebrities and to ensure the healthy and steady development of the Internet celebrity economy,it is necessary to construct a criminal law response path:uphold the concept of modest and restrained criminal law;flexible judicial interpretation;and prudent criminal legislation.
