随着短视频行业的渐趋成熟,视听作品被擅自剪辑、录制、模仿与搬移的短视频版权侵权问题日益猖獗。侵权现象频发的原因主要在于现有保护规则适用失灵、司法与行政保护存在先天局限性,平台方技术监测水平不足。因此,应当完善短视频保护规则,加固保障短视频版权安全的法律通道;依托大数据与人工智能技术、发挥各方主体力量搭建以正版作品数据库为前提的版权过滤机制,以建立短视频版权长效保护机制。

Short video copyright infringements in which audiovisual works have been edited,recorded,imitated,and moved without authorization have become increasingly rampant.The frequent infringements are mainly due to the failure to apply the existing protection rules,the inherent limitations of judicial and administrative protection,and the insufficient level of technical monitoring by the platform.Therefore,it is necessary to improve short video protection rules and strengthen legal channels to protect the copyright security of short videos;relying on big data and artificial intelligence technology,and exerting the strength of all parties to build a copyright filtering mechanism based on a database of genuine works,to establish a copyright filter for short videos.Effective protection mechanism.
