我国传销犯罪研究的可视化回顾与理论反思

Visual review and theoretical reflection of research on pyramid selling crime in China

通过分析我国传销犯罪的研究变迁,揭示该领域研究前沿和发展趋势,为进一步研判传销犯罪的发展规律、完善法律规制措施、打击传销诈骗犯罪、保护商业模式创新和企业产权提供决策参考。以CSSCI与北大核心中收录的“传销”相关的主题论文为数据来源,通过文献计量工具对传销犯罪研究进行可视化回顾。结果显示,该领域研究的相关理论历经了“传销行为进入法律视野”“传销行为的刑事规制”“新型传销的查处与规制”三个时期,目前在研究方法、程序及证据理论、实体刑事规制等方面依旧薄弱,应当兼顾规范研究与实证研究,立足国情的同时广泛借鉴国际先进经验,实现应用与理论研究的并重。

By analyzing the research changes of pyramid selling crime in China,this article reveals the research frontier and development trend in this field.This study provides decision-making reference for further studying and judging the development law of pyramid selling,improving legal regulation measures,combating pyramid schemes fraud,and protecting business model innovation and enterprise property rights.Based on CSSCI and the"pyramid selling"related articles collected in the key journals of Peking University as data sources,this article will visualize the research on pyramid selling crime through bibliometric tools.The result shows that related theories have gone through three stages including"pyramid selling behavior into the legal horizon""criminal regulation of pyramid selling behavior"and"investigation and regulation of new pyramid selling".At present,pyramid selling crime research is still weak in research methods,procedures and evidence theory,substantive criminal law regulations and other aspects.In the future,both normative research and empirical research should be considered.Based on domestic conditions,advanced international experience should be widely referred,and both application and theoretical research shall be equally paid attention.
