党内法规解释的规范性分析及完善思路

Normative Analysis and Improvement of the Interpretation of the Party Regulations

中国共产党党内法规解释是党内法规制度体系的重要内容,具有表达政治价值、明晰执纪空间、强化立规执规等功能。在规范性方面,当前党内法规解释的主体、对象、内容、名称存在滞后性;在适用性方面,党内法规解释对党的十八大以来党内法规新发展关注不足,未能对新出台的党内法规作出相应解释,党内法规解释与新的政治要求存在"脱节"。要强化党内法规解释的作用,应推动完善党内法规解释制度体系、重视非正式党内法规解释和建立完善指导性案例制度。

The interpretation of the Party regulations of the CPC is an important part of Party regulations system,which has the functions of expressing political value,clarifying the space of discipline enforcement,and strengthening the establishment and enforcement of regulations.In terms of standardization,the subject,object,content and name of the current interpretation of the Party regulations need updating;in terms of applicability,the interpretation of the Party regulations does not pay enough attention to the new development of the Party regulations since the 18 th CPC National Congress,and fails to give corresponding explanations to the newly issued Party regulations,which leads to its separation from new political requirement.To strengthen the role of interpretation of Party regulations,we should improve the system of Party regulations interpretation,attach importance to informal interpretation of Party regulations,and establish the guiding case system.
