我国网络购物在线纠纷解决机制探究

Research on the Online Resolution of Online Shopping Disputes in China

积极发展多元化纠纷解决机制是我国司法改革的工作重点。网络购物在线纠纷解决机制作为一种新兴的纠纷解决模式,主要由平台内部纠纷解决、在线调解、在线仲裁三大模式构成。但是,该机制目前处于初步发展阶段,程序混乱,法律缺失,缺乏统一管理,难以发挥应有作用。为促进机制依法有序发展,应当对其进行改革。基于我国现阶段各类纠纷解决机制发展情况,可以探索一条以“智慧法院”为主导,科技赋能为支撑,立法和监督为保障的综合性网络购物在线纠纷解决机制的改革路径。

The diversity of dispute resolution mechanisms is the focus of China’s judicial reform.Online dispute resolution has become a new dispute resolution mode,containing three elements:internal dispute resolution,online mediation and online arbitration.However,this mechanism is still in the early stage of development,and a variety of problems such as the complicated procedures and lack of law and unified management make it less effective.To promote the development of this mechanism,this article proposes a comprehensive online dispute resolution mechanism which is led by smart courts,supported by technologies,and safeguarded by legislation and supervision.
