Study of the Role of Soft Law in the Self-Governance of Villagers

基层民主自治现代化是乡村振兴的关键环节,软法治理是一种契合村民自治的基层治理模式。以村民自治作为切入点,探讨软法治理在化解社会矛盾、推进农村治理现代化、节约乡村治理成本等方面的意义,分析研究软法治理模式村民参与程度低、治理主体不清、制定缺乏程序性、软硬法之间缺乏协调机制等问题,提出提升村民参与程度、明确软法治理的主体、建立程序正当的软法制定机制、建立软法与硬法的有效衔接的建议。

The modernization of self-governance is a key step to achieve the prosperity of countryside,and soft law is a suitable way for villagers to govern their villages.This article explores the roles of soft law in resolving social conflicts,promoting the modernization of village governance and saving the costs of village governance,and finds the problems existed in the governance of villages such as the inadequate participation of villagers and the lack of clarified governance subjects and procedures and a mechanism that coordinates soft laws and hard laws.This article suggests promoting the participation of villagers,clarifying the subjects of village governance,building legitimate procedures for the making of soft law and increasing the coordination of soft laws and hard laws.
