我国刑事强制医疗程序的执行审视与展望

Review and Prospect of the Implementation of Criminal Compulsory Medical Procedure in China

我国刑事强制医疗程序运作中的部分障碍已经凸显,诸如精神病司法鉴定的乱象、费用承担主体的不明确、程序解除困难重重、检察监督力不从心等,已经实际阻碍了程序的运作,急需解决。还有部分问题,诸如该程序的适用对象的范围是否扩大、该程序与普通程序的衔接与互动关系、强制医疗程序的证明标准、精神病鉴定的启动主体是否扩大、被害人是否享有附带民事诉讼的请求权等问题,需要未雨绸缪,尽早解决。否则,该程序可能会在重压之下走向歧途。

In the operation of China's criminal compulsory medical procedure some obstacles have become obvious,such as messed psychiatric judicial appraisal,uncertainty of the cost bearing subject,difficulties in lifting the procedure,and incompetence of procuratorial supervision.All this has actually hindered the operation of the procedure and need be solved urgently.There are also some problems,such as whether the scope of the application object of the procedure should be expanded,the link and interaction between the procedure and ordinary procedures,the standard of the compulsory medical procedure certificates,whether the starting subject of psychiatric appraisal should be expanded,and whether the victim enjoys the claim right of incidental civil litigation,which need to be prepared and solved as soon as possible.Otherwise,the procedure may go astray under heavy pressure.
