新业态从业人员职业伤害保障制度建设的思考 被引量:1

摘要 《人力资源和社会保障事业发展“十四五”规划》中提出“推进平台灵活就业人员职业伤害保障工作”,这就需要结合我国新业态用工特点,制定职业伤害保障试行办法,因此开展新业态从业人员职业伤害保障试点工作成为重要一步。根据新业态行业就业现状,梳理总结新业态从业人员职业伤害保障制度现有模式,分析各模式实施的效果,发现在建立健全该制度的过程中仍然存在困难。为更好地保障新业态从业人员的权利与义务,还需要完善法律制度,提高法律层级,各级主体积极参与,相关部门紧密结合,进一步在共享经济发展中发挥积极作用。 In“The 14th Five-Year Plan”for the Development of Human Resources and Social Security,it is proposed to“promote the occupational injury protection work of flexible employment personnel on the platform”,which requires the formulation of pilot measures for occupational injury protection in combination with the characteristics of new forms of employment in China,and promote the pilot project of occupational injury protection for flexible employment personnel on the platform.According to the employment status of the new industry,this paper summarizes the existing mode of occupational injury protection system for employees of the new industry,analyzes the effect of the mode,and finds that there are still difficulties in the process of establishing and improving the system.In order to better protect the rights and obligations of employees of new business forms,it is necessary to improve the legal system,improve the legal level,with active participation of subjects at all levels and close integration of relevant departments,and play a positive role in social members’sharing of economic development.
