平台监管逻辑的反思与重构——兼对包容审慎监管理念的再反思

Reconsideration and Reconstruction of the Logic of Platform Regulation and Reconsideration of the Concept of Inclusive Prudential Regulation

新一轮技术革命的演化为平台经济的兴起提供了技术支撑,平台企业成为驱动经济增长的新引擎,但随之而来的负面社会问题也成为监管主体必须面对的顽疾。在以包容审慎为监管理念的框架中,政府、平台、用户等不同社会主体均对平台经济承担着一定的监管责任和义务,形成了平台公共监管、平台自我监管以及平台用户监管三种主要的监管模式。然而,不同社会主体对平台的监管又与平台成长逻辑形成悖论,难以形成公认有效的监管模式。对包容审慎监管理念进行再反思,需要从平台监管的三维审视框架重构监管逻辑。提出“对产业包容、对企业审慎”的监管理念以及“对创新包容、对技术审慎”的监管原则,并结合创业平台、成长平台、超级平台等的不同特点,明确了监管的重点方向。结合平台属性、平台生命周期、平台网络外部性等因素,构建了公共政府监管、平台监管与用户监管分类主导的全新平台监管模式。

The evolution of a new round of technological revolution provides technical support for the rise of platform economy,and platform enterprises have become a new engine to drive economic growth,but the attendant negative social problems have also become a stubborn disease that regulators must face.The three modes of self-regulation,namely,the platform of economic inclusion,the platform of prudential regulation and the platform of self-regulation,are formed in the platform of public regulation.However,the regulation of different social subjects on the platform is in contradiction with the logic of platform growth,so it is difficult to form a recognized and effective regulation model.This paper rethinks the concept of inclusive prudential regulation and believes that it is necessary to reconstruct the regulatory logic from the three-dimensional framework of platform regulation,then we put forward the regulation concept of“industrial inclusion and enterprise prudence”and the regulation principle of“innovation inclusion and technology prudence”,and clarify the key direction of regulation in combination with the different characteristics of entrepreneurship platform,growth platform and super platform.Finally,this paper reconsiders the logic of platform regulation,and believes that platform regulation should be combined with the three-dimensional framework of platform attribute,platform network externality and platform life cycle to reshape the regulatory system of platform classification and subsection,and finally form a new logical framework of platform regulation.
