民警枪支使用适用情形问题研究

A Study on the Application Conditions for Police to Use Firearms

民警适用枪支使用情形时,常会心存疑虑,集中体现在对“暴力犯罪行为”的判明及“紧急情形”“使用原则”“使用时机”等问题的把握上。适用枪支使用情形时,对于紧急情形的理解不能一概而论,将暴力犯罪行为的正在发生必然联系为紧急情形。对枪支使用适时原则应着重把握犯罪情形的暴力程度及紧迫程度;对枪支使用适度原则,应把握“以制止为度”和使用结果的法益相称性等。民警在提升把握枪支适用情形能力上要畅通网络援助渠道、革新实训援助内容,力求建立立体的、全方位的援助机制。

When police use guns,they often have doubts on their judgement of the violent degree of the crime,how urgent the situation is,what are the principle of use and when to use.As for the application conditions of gun use,the understanding of urgency can not be generalized.If the violent crime is on-going,it is an urgent situation.The principle of“timely use”of firearms should focus on the degree of violence and urgency of crime.The principle of moderation in the use of guns should be based on deterrence and proportionality of legal interests.In order to improve the police’s ability to grasp the application conditions of firearm use,it is necessary to open up the network aid channel,innovate the training aid content,and strive to establish a three-dimensional and all-round aid mechanism.
