广东省建设项目竣工环境保护自主验收存在问题分析研究

Analysis and Research on Problems Existing in Self-Acceptance of Environmental Protection for Construction Projects Completed in Guangdong Province

根据《建设项目竣工环境保护验收暂行办法》(国环规环评[2017]4号)和《关于进一步做好建设项目环境保护“三同时”及自主验收监督检查工作的通知》(环办执法[2020]11号)有关要求,采取按项目广东省内全覆盖、环评审批部门级别分级以及重点行业随机抽取的原则从建设项目竣工环境保护验收信息系统抽取64个建设项目竣工环境保护验收文件进行技术复核。结果表明:51.56%的建设项目违反《建设项目竣工环境保护验收暂行办法》第八条、第十六条及《建设项目环境保护管理条例》第二十三条相关规定。广东省建设项目竣工环境保护自主验收管理存在事后监督管理力度不足、验收过程缺乏约束机制、基层环评及执法部门业务技术水平不足等问题。下一步亟须加强建设项目竣工环境保护自主验收配套制度建设,完善自主验收信息系统,建立自主验收信用平台,进一步加强基层环评及执法部门业务能力建设。

According to the relevant requirements of the Interim Measures for acceptance of environmental protection after completion of construction projects(ghgheia[2017]No.4)and the notice on further improving the"three Simultaneities"and independent acceptance supervision and inspection of environmental protection of construction projects(HBJ[2020]No.11),the project is fully covered in Guangdong Province.According to the principle of level classification of EIA approval departments and random selection of key industries,64 completion environmental protection acceptance documents of construction projects are selected from the completion environmental protection acceptance information system for technical review.The results showed that 51.56%of the construction projects violated the relevant provisions of Articles 8 and 16 of the Interim Measures for acceptance of environmental protection after completion of construction projects and Article 23 of the regulations on the administration of environmental protection of construction projects.There are some problems in the independent acceptance management of environmental protection after the completion of construction projects in Guangdong Province,such as insufficient post supervision and management,lack of restraint mechanism in the acceptance process,and insufficient business and technical level of grass-roots environmental assessment and law enforcement departments.In the next step,it is urgent to strengthen the construction of supporting systems for independent acceptance of environmental protection after the completion of construction projects,improve the independent acceptance information system,establish an independent acceptance credit platform,and further strengthen the business capacitybuilding of grass-roots environmental assessment and law enforcement departments.
