摘要
人工智能的发展打破了人类对艺术创作的垄断,传统的著作权法理论无法对社会现实的变革作出充分回应,因此对原有体系的突破在所难免。在对作品的认定上,应当从以作者为核心转向以读者为核心,以此确认人工智能生成物的作品性;在著作权的权属制度方面,将人工智能的投资者“视为作者”;在权利内容上,应当将以人工智能生成物为权利客体的著作权与以人类作品为权利客体的著作权相区别,划定人工智能生成物著作权的边界。
The emergence of artificial intelligence has broken the human monopoly on artistic creation.The traditional theory of copyright law failed to respond to the changes in social reality,hence,a breakthrough in the original system is inevitable.In the identification of works,the focus should be shifted from the author to the reader to confirm the nature of artificial intelligence products;in terms of copyright ownership system,investors of the artificial intelligence are considered as authors;In terms of the content of rights,the“copyright of artificial intelligence products as the object of rights”should be distinguished from the“copyright of human works as the object of rights”,and the boundary of the copyright of artificial intelligence products shall be defined.
