摘要
随着一系列算法新规的出台,中国算法规制体系日渐成型,但其实践脉络尚未被梳理,理论症结尚未被探明。立基于《关于加强互联网信息服务算法综合治理的指导意见》《互联网信息服务算法推荐管理规定》和既有监管经验,中国形成了包括"国家网信办"(规制主体)"算法服务"(规制对象)和"巡警机制、火警机制、片警机制"(规制工具)在内的外部规制结构,以及以"算法安全""算法公平""算法向善"为依归的内在规制价值。尽管中国算法规制体系已经初步建立,但仍未臻完善。为此,有必要引入"算法发展"平衡算法安全,引入"权利公平"补充算法公平,引入"私人自主"调和算法向善,进而推动规制主体分工协作、拓展规制对象范围、优化规制工具,以铸就彰显中国风格、体现中国智慧的算法规制体系。
With the implementation of a series of new regulations about the algorithm, China’s regulatory system of algorithm is gradually taking shape. But its practical context has not been clarified, and the theoretical crux has not yet been explored. Based on the Guiding Opinions on Strengthening the Comprehensive Management for Algorithms of Internet Information’s Services, the Administrative Provisions on Algorithm Recommendation of Network Information Services and existing regulatory experience, China has formed an external regulatory structure including the Cyberspace Administration of China(the main body of regulation), algorithm services( the object of regulation) and mechanisms of police patrol, fire alarm and film police(the tools of regulation). Meanwhile, China has also formed an internal regulatory values including Algorithmic Security, Algorithmic Fairness and Algorithmic Beneficence. Although it has already formed a basic system, it still has a long way to go. Therefore, it’s necessary to introduce Algorithmic Development to balance algorithmic security, to introduce Right’s Fairness to balance algorithmic fairness and to introduce Private Automony to balance algorithmic beneficence. In this way, it enables to promote the division of coordination of regulatory bodies, expand the range of regulatory objects and optimize regulatory tools in order to show China’s style and regulatory system of algorithm which reflects Chinese wisdom.
