摘要
以电信网络诈骗为代表的新型网络犯罪案件在证明判断中时常陷入定罪困难与权利保障的困境。电子数据证据是网络犯罪案件中重要的证据形式,剖析网络犯罪案件的细致问题,可以将电子数据证据作为分析凭借。从微观视角着眼,电子数据证据具有获取难、固定难、认定难的本体特征,其本体特征将引发证明力平面化的现象;从中观视角审视,网络犯罪证明环节存在定罪证明指向力分散、定量证明技术性乏力的症结。网络犯罪的印证证明需要进行融贯性升级,引入多元的证明方法,强化证据能力规则的准入把关与质量验算,细化侦查的取证与存证。
The proof of evolved cybercrime cases represented by cyber-telecom fraud often encounters conflict between conviction and rights protection. Digital data evidence, which is an important form of evidence in cybercrime cases, can be relied upon in analyzing the detailed issues of cybercrime cases. From the micro perspective, digital data evidence’s essential feature, which consists of difficult acquisition, difficult seizure, and difficult authentication,will give rise to the phenomenon of planarizing the weight of evidence. From the mesoscopic perspective, proof of cybercrime also encounters problems. For example, the strength of digital evidence in proving guilt is dispersed, and the quantification of digital evidence’ probative value is undermined by technical weakness. The corroboration model applied in proof of cybercrime needs to be upgraded by incorporating the idea of coherence. It is necessary to introduce pluralistic proof methods, strengthen the evidence credibility evaluation rules especially in the admissibility control and the evidence weight calculation, and refine the operation of evidence collection and storage in cybercrime investigation.
