保护知识产权就是保护创新,合理评估专利侵权赔偿数额,有利于维护专利人合法权益,也是知识产权保护的重要途径。随机下载了2018-2020年间全国专利侵权诉讼判决书进行分析,得出法定赔偿确定方式偏高、侵权赔偿金额低、侵权赔偿判赔比例低是目前我国专利权领域侵权赔偿的基本特点。本文讨论了实践中常用的几种专利价值评估方法的适用性,并对我国未来专利侵权赔偿评估提出了建议。

Protecting intellectual property is important for innovation. Reasonable evaluation of the amount of patent infringement compensation is conducive to safeguarding the legitimate rights and interests of the patentee, and also an important way to protect intellectual property rights. We randomly downloaded the national patent infringement litigation judgment from 2018-2020 for analysis. It is concluded that the highly used of statutory compensation method,the low amount of infringement compensation and the low compensation proportion are the basic characteristics of patent rights infringement compensation in China. The paper discusses the applicability of several patent value evaluation methods in practice and proposes the future patent infringement compensation evaluation.
