市域社会治理的地方立法模式及其完善

The Local Legislative Model and the Perfection of Municipal Social Governance

市域社会治理现代化与设区的市的地方性法规制定权天然契合。实践中,已形成"统一型""分散型"和"渗透型"并存的"三元式"市域社会治理地方立法格局。"统一型"立法模式的示范引领作用有待观察。"分散型"立法模式须进行系统化整合。"渗透型"立法模式应深入贯彻治理理念并提升保障措施的可操作性。市域社会治理地方立法的完善措施包括鼓励多模式探索市域社会治理地方立法,赋予设区的市更广立法权,贯彻治理理念和提升法制措施操作性,发挥地方文化优势构建特色社会治理制度,加强立法后评估。

The modernization of municipal social governance(MSG for short)naturally coincides with the power to formulate local regulations of cities divided into districts.In practice,the local ternary legislative model of MSG includes"unified","decentralized"and"infiltrated"forms.The demonstration and leading role of"the unified legislative model"remains to be observed.The second model must be systematically integrated and the third should thoroughly implement the concept of governance and improve the operability of safeguard measures.The measures to improve local legislation of MSG are as follows:granting wider legislative powers to these cities,encouraging multi-model exploration of local legislation for MSG,implementing governance concepts in the legislative process and improving the operability of legal measures,and giving full play to the advantages of local culture and constructing a characteristic social governance system and strengthening post legislative evaluation.
