检察民事公益诉讼调查核实权研究——基于双重路径视角

Research on the Investigation and Verification Right of the Procuratorate in Civil Public Interest Litigation——Based on the Dual Path Perspective

检察民事公益诉讼调查核实权具有法律监督权和当事人证明权的双重属性,应从诉前和诉讼阶段对该权能进行二元区分。我国调查核实权的内部问题有调查核实手段单一、规范层级低和保障不足等,外部问题为被调查核实对象配合度不高和检察人员业务能力不足等。通过对内外部问题作成因分析,应构建双重路径予以完善:内部路径为规制行使方式、区分适用阶段和配置责任条款等;外部路径为强化人员配备、建立专家库制度和加强一体化办案机制建设等。

The right of investigation and verification in civil public interest litigation has the dual attributes of the right of legal supervision and the right of proof of the parties,which should be distinguished from the pre-litigation and litigation stages.The internal problems encountered by the right of investigation and verification in China include single investigation and verification methods,low level of regulation and inadequate protection,while the external problems are low cooperation of the subject of investigation and verification and inadequate professional ability of the prosecutors.By analyzing the causes of internal and external problems,the dual path should be improved:the internal path is to regulate the way of exercise,distinguish the applicable stages and allocate responsibility provisions;the external path is to strengthen the personnel arrangements,establish expert database system and improve the construction of integrated case handling mechanism.
