Annual Review on Intellectual Property Cases Decided by the U.S.Supreme Court in 2020 Term

文章考察了美国最高法院最新的知识产权司法审判,分别介绍其在2020年度审结的包括甲骨文公司诉谷歌公司软件著作权侵权案在内的3件知识产权案件的事实和判决理由,并就著作权合理使用规则、专利行政法官与双方复审程序、专利让与人禁止反悔规则等法律问题作出评析,最后指出它们对美国乃至国际知识产权制度与实践的影响以及对于我国的参考意义。

This article surveys the latest judicial cases on intellectual property decided by the U.S.Supreme Court in 2020 term.Firstly,it illustrates the facts and reasonings of these three cases including Oracle v.Google,and other patent cases.Then it analyses the legal issues of fair use doctrine,the patent administrative judges and their role in the process of inter partes review,and the doctrine of assignor estoppel respectively.In the end,it provides some insights on the influence of these cases to the development of intellectual property system and practices in the U.S.and China.
