论RCEP知识产权条款与中国企业的应对

On the Terms of Intellectual Property Chapter of RCEP and the Countermeasures of Chinese Enterprises

RCEP知识产权条款,横向地看,与TRIPS、TPP、CPTPP知识产权条款相比,一定程度上体现了发达国家TRIPS-Plus的要求;纵向地看,重视了发展中国家的诉求,反映了对发展中国家转移技术的宽容和后者在知识产权协调活动中话语权大幅提升的趋势。这些条款将为各成员知识产权制度建设提供指引,也为中国企业走出去提供了制度保障和机遇。但其所要求的打击恶意商标、数字环境下的执法与中国当前实践存有冲突,将给中国企业带来挑战。企业在经营活动中首先应当提升知识产权保护意识,了解他国相关法规,防止自己的权利因缺乏国际保护标准而在知识产权制度较为落后的国家遭到侵害;其次应合规经营,确保技术转移过程中手段合理、流程规范,确保自身经营活动不侵犯他人知识产权。

From the horizontal comparison with TRIPS and the intellectual property(IP)chapters of TPP and CPTPP,the IP chapter of RCEP reflects the standard of TRIPS-plus proposed by developed countries to a certain extent;from the vertical comparison with the negotiation texts,the IP chapter of RCEP also attaches importance to the demands of developing countries,reflecting the willingness of developed countries to transfer technology to developing countries and the trend of improving the discourse of developing countries during the international harmonization of IP.The terms in the IP chapter provide guidance for the construction of members'IP legal system,and also provide protective institutions and opportunities for Chinese enterprises going global.However,there are conflicts between its requirements to regulate malicious trademarks and infringement in digital environment,and China's current practice,which will bring challenges to Chinese enterprises.Therefore,enterprises should first raise their awareness of IP protection in their business activities,understand the relevant laws and regulations of other countries,and prevent their rights from being infringed in countries with relatively backward IP systems due to the lack of international coordination standards;Secondly,enterprises should also operate in compliance with regulations to ensure that the process of technology transfer are reasonable and standardized and that their business activities do not infringe intellectual property rights of others.
