高校办学自主权与学生学位获得权的冲突与平衡——以博士学位授予需发表论文为视角 被引量:21

摘要 许多高校都规定博士学位授予需发表核心期刊论文,并认为这是高校办学自主权的体现。这是对高校办学自主权的误读。高校办学自主权有其特定范围,高校在制定学位授予工作细则时必须严格依法进行,坚守权限边界。高校在学位论文之外增设发表论文条件以及各高校所规定发表论文数量和质量的差异性,侵犯了学生依法获得学位的权利和学位获得的平等权利。我国必须尽快出台学位法,分门别类地规定博士学位授予条件和标准,明确将博士学位论文作为考察学生科研能力的基本标准并完善学位论文审查考核机制,划定各授予单位制定学位授予标准的权限边界,从根本上实现高校办学自主权与学生学位获得权间的平衡。 Many universities have stipulated the conditions for the publication of the core journal articles for doctoral degree granting,which is considered as the embodiment of university autonomy.This is a misreading of the university autonomy.The university autonomy has its spe-cific scope,and the university must strictly stick to the boundary of power when drawing up the detailed rules of degree granting.The conditions of publishing papers in addition to the disserta-tions in universities and the different rules on the number and quality of published papers in dif-ferent universities violate the rights of students to obtain degrees according to law and the equal rights in terms of getting a degree.A degree law must be promulgated as soon as possible,and the conditions and standards for the granting of doctoral degrees must be stipulated.At the same time,the degree law should clearly take the doctoral dissertations as the basis for investigating the students research ability,improve the mechanism of examination and verification of the dis-sertations,and delimit the power boundary of setting the standards for the granting of degrees by universities,in order to fundamentally realize the balance between the university autonomy and the right of students to obtain a degree.
