教育法典编纂背景下教育法律救济制度的规则探究 被引量:12

摘要 现行教育单行立法模式下,教育法律救济制度规则之间缺乏体系性的内在逻辑衔接、制度之间存在功能重叠和部分法律空白,以致教育权利难以获得充分保障。教育法典的立法目的和基本功能是保障教育权利教育法典编纂中理性规划教育法律救济制度应当考量教育法律关系的综合性、教育事项的专业性、学校的自治性和教育的伦理性等特殊因素,遵循"总则+分则"的立法体例,在衔接上突出学校内部救济,在形式上实现公法和私法、实体和程序救济的二元协同共济,在内容上通过不同救济类型的分类分工形成体系上的衔接配套,最终实现教育权利的全方位保护。 Due to the lack of a unified legislative plan,the existing education law model lacks a systematic and logical connection between the rules of the education legal remedy system,and there are overlapping functions and some legal gaps between the systems,which makes it difficult to fully protect the right to education.The legislative purpose and basic function of the education code is to guarantee the right to education,and the education legal remedy system under the background of education code codification should respect the comprehensive nature of education legal relations,the professionalism of education matters,the autonomy of schools and the ethical nature of education,follow the legislative style of“general rules+sub-rules”,highlight the internal remedy of schools in terms of articulation,and realize the public and private law remedy in terms of form.In terms of form,it should realize the duality of public and private law remedies,and the duality of substantive and procedural law,and in terms of content,it should form a systemic linkage through the classification of different types of remedies,so as to finally realize the all-round protection of educational rights.
