家庭暴力犯罪实证研究——基于相关司法判决大数据报告

EMPIRICAL STUDY OF DOMESTIC VIOLENCE CRIMES:BASED ON DATA REPORTS ON RELEVANT JUDICIAL DECISIONS

家庭暴力犯罪作为发生在家庭成员间的犯罪,有不同于普通刑事犯罪的众多特殊之处。根据对相关司法判决大数据的分析,发现实践中的家庭暴力犯罪存在犯罪黑数大、告诉比例低、恶性犯罪多、举证困难、定罪量刑标准不一等问题。针对这些问题分别从更新思想观念、激活组织机构、完善法律规范等三方面提出建议,以完善防治家庭暴力犯罪体制。

As a crime committed among family members,domestic violence crime has many special features different from ordinary criminal offences.According to the analysis of the big data of relevant judicial judgments,it is found that in practice,there are many problems such as the number of crimes committed in the family violent crime,the low proportion of telling,the number of vicious crimes,the difficulty of proof,the different standards of conviction and sentencing,and so on,in view of these problems,they make suggestions from the three aspects of updating the concept consciousness,activating the organization and perfecting the legal norms,and perfect the system of crime prevention and control of domestic violence.
