Using Procedural Thinking to Align Politics with Rule of Law:A Study of Xi Jinping’s Discussion on the Procedural Rule of Law

政治与法治是共生关系,二者的运行逻辑又有天然的紧张关系。中国法治道路深受政治的塑形和影响,形成了独具特色的政治运行机理。中国的法治理想是建设形式法治与实质法治高度统一的中国特色社会主义法治国家。形式法治与实质法治的轩轾集中反映为法治与政治的纠结。中国的现代化建设客观上要求将政治与法治有效地调和起来,既不能用政治废法治,也不能以法治废政治。习近平法治思想中关于程序法治的论述为其指明了思考的方向,即要学会运用程序思维和程序方法破解政治与法治的关系难题,实现党的领导与法治的高度统一。

Politics and the rule of law are in a symbiotic relationship,though naturally there is tension between their operation logics.China’s road to rule of law has been deeply shaped and influenced by politics,and has formed a unique political operation mechanism.China’s ideal of rule of law is to build a law-based socialist country with Chinese characteristics featuring a unification between formal rule of law and substantive rule of law.The formal rule of law and the substantive rule of law are reflected in the entanglement between rule of law and politics.China’s modernization drive objectively requires us to effectively align politics with rule of law.We can neither replace rule of law with politics,nor replace politics with rule of law.In Xi Jinping Thought on Rule of Law,the discussion on the procedural rule of law has pointed out the direction for our thinking.We should learn to use procedural thinking and methods to resolve the tension between politics and rule of law,and realize the great unity of the Party’s leadership and rule of law.
