创新是引领发展的核心动力,知识产权则是创新的重要前提,先进技术和高科技产业都高度依赖知识产权的有效保护。以色列之所以成为“创业的国度”和“创新型经济体”,在很大程度上得益于对知识产权的高度重视,形成了比较完善的知识产权保护体系及知识产权交易市场,其知识产权创造力也成为国家创新竞争力的重要体现。比较完善的知识产权立法、深度融入国际知识产权保护模式是以色列的经验所在。自中以确立“创新全面伙伴关系”以来,两国在高科技领域的合作已成为研究热点。研究以色列的知识产权保护制度,探讨其法制建构及其国际化特征,对于加强双边的知识产权和技术合作,提升我国的知识产权竞争力,建设创新型国家具有一定的借鉴作用。

Innovation is the core driving force to spearhead development,and intellectual property rights(IPR)is an important prerequisite for innovation.Advanced technologies and high-tech industries are highly dependent on the effective protection of intellectual property.The reason why Israel has become a Start-up Nation and Innovative Economy has largely benefited from attaching great importance to IPR,forming a relatively complete IPR protection system and IPR trading market,and its IPR creativity has also become an important manifestation of national innovation competitiveness.The Israel's experience lies in its relatively sound IPR legislation and deep integration into international IPR models.Since the establishment of the Sino-Israel Innovative Comprehensive Partnership,the cooperation between the two countries in the field of high technology has become a hot spot.Studying Israel's IPR system,exploring its legal structure and its Internationalization characteristics,will have certain enlightenment for strengthening bilateral IPR and technical cooperation,enhancing China's IPR competitiveness as well as building an innovative country.
