关于《中华人民共和国国家情报法》的若干思考

Research on the State Intelligence Law of the P.R.C

[研究目的]从情报学相关内涵入手,探讨《中华人民共和国国家情报法》(以下简称为《国家情报法》)中值得借鉴思考的部分,加强国家情报法的总体性作用,完善情报法律体系网络。[研究方法]通过文献研究方法和比较研究法,以国内外对情报的相关研究为基础,提出情报的内涵及其分类并就情报机构、情报监管、情报人员保障等方面展开分析。[研究结论]应重视对情报的定性研究,通过对情报定义、推动情报体系完善,监管部门立法、促进人员保障、加快情报互传互信,最终完善国家情报工作体制,建立健全情报法律网络体制。

[Research purpose]Starting from the relevant connotation of intelligence,this paper discusses the parts worth reference and thinking in the State Intelligence Law,strengthens the overall function of the intelligence law,and improves the network of the intelligence law system.[Research method]Based on the relevant research on intelligence at home and abroad,this paper puts forward the connotation classification of intelligence,and combines the characteristics of the existing information science system to perfect the measures of intelligence organization,intelligence classification,intelligence supervision,intelligence personnel guarantee and so on.[Research conclusion]We should attach importance to qualitative research on intelligence,and finally perfect the national intelligence work system and establish and perfect the intelligence legal network system by defining intelligence,promoting the perfection of the intelligence system,supervising the legislation of departments,promoting personnel guarantee and accelerating the mutual transmission and mutual trust of information.
