The Institutional Supply of Belt and Road Infrastructure Investment:Status,Foundation and Path Choice

当前,“一带一路”基础设施投资的制度供给处于相对缺位状态,不能满足沿线国家对基础设施投资安全与投资便利化的制度需求,实现“一带一路”基础设施投资的有效制度供给就具有了必要性。通过长期互联互通,中国与沿线国家在投资领域逐渐形成了共同观念、共同利益与共同合作文件,为基础设施投资的制度供给奠定了基础。在“一带一路”倡议引领下,“一带一路”基础设施投资的制度供给将沿着具有渐进性、包容性与互利性的内生性规则方向整合与优化路径,该路径的内容包括国际基础设施投资规则制定权在形式上的相对集中行使、基于多边主义的国际立法合作以及规则整合层次的提升。该路径的目的是缔结“一带一路”基础设施投资协定,解决“一带一路”基础设施投资制度供给存在的问题,在国际投资规则改革中融入中国声音,推进国际投资制度的发展,促进中国与沿线国家在基础设施投资领域的共建共享与互利共赢。

At present,the institutional supply of the Belt and Road infrastructure investment is relatively absent,which is not able to meet the institutional needs of countries along the Belt and Road Initiative for the security and investment facilitation of infrastructure investment.Therefore,it is necessary to establish an effective institutional supply for Belt and Road infrastructure investment.Through the cooperation of long-term connectivity projects,China and countries along the Belt and Road Initiative have gradually formed common concepts and interests and signed joint cooperation documents in the field of investment,laying a foundation for institutional supply of infrastructure investment.Under the guidance of the Belt and Road Initiative,the institutional supply of infrastructure investment will integrate and optimize its path by following a gradual,inclusive,mutually beneficial and endogenous rule.This path includes the relatively centralized exercise of the rule-making power of international infrastructure investment,the international law-making cooperation based on multilateralism and the improvement of the level of rule integration.The purpose of this path is to generate an investment agreement of Belt and Road infrastructure,to solve the existing problems of institutional supply,to integrate China's voice into the reform of rules of international investment system,to promote the integration process of rules of international investment,to promote joint construction,and to share the mutual benefit between China and countries along the Belt and Road Initiative in the field of infrastructure investment.
