Discussion on the Revision of the“Wildlife Protection Law”

《野生动物保护法》施行三十余年,对于促进野生动物保护起着至关重要的作用。然而,在新冠肺炎疫情的冲击下,其中的部分内容显露出不足,全国人大常委会出台的《决定》可以应一时之急,但最根本的办法是对《野生动物保护法》进行修改。通过对现行法律的考察,检视《野生动物保护法》在立法理念、监管职能以及法律责任等方面存在的问题,并提出相应的完善建议,同时加强疫源疫病监测防控、栖息地建设、公众参与等制度建设,从而推进野生动物保护法律制度的进一步完善,为人类与野生动物的和谐共生提供更加坚实的法治保障。

The"Wildlife Protection Law"has been in force for more than 30 years and has played a vital role in promoting wildlife protection.However,under the impact of the COVID-19,some of its contents have shown deficiencies.The"Decision"issued by the Standing Committee of the National People's Congress can be a temporary emergency,but the most fundamental way is to amend the"Wildlife Protection Law."Through the investigation of the current law,this article examined the existing problemsof"Wildlife Protection Law"from the aspects of legislative concepts,regulatory functions and legal responsibilities,and proposed corresponding suggestions for improvement.At the same time,this article suggested to strengthen the prevention and control of epidemic disease,habitat construction and public participation,so as to promote the further improvement of the wildlife protection legal system and provide a more solid legal guarantee for the harmonious coexistence of humans and wildlife.
