案例分析是法学案例教学的核心和灵魂。案例分析中的分析是指运用特定方法对法学案例进行分解、提炼或厘清,使某些内容清晰展现出来,从而实现教学目的。法学案例分析方法可以概括为四种:概念分析,以理解法学概念为目标,通过法律概念与具体案例对比,理解法律概念的丰富内涵;规范分析,强调以法律规范为核心,在案例中理解法律规范的含义、存在及运行方式;矛盾分析,以揭示案例中存在的各种冲突为重点,理解有关法律产生发展的必然性,认识法律的独特作用;批判分析,是指对案例中的规则、裁判等进行反思,辩证思考可能存在的不足与完善对策。案例分析方法的运用受案例内容、教学目的以及教学对象等因素制约。

Case analysis is the core and soul of law case teaching. Analysis in case analysis refers to the use of specific methods to decompose, refine or clarify legal cases, so that some contents can be clearly displayed, so as to achieve the purpose of teaching. There are four legal case analysis methods: Concept analysis aims to understand the concept of law, and understand the rich connotation of legal concept through the comparison between legal concept and specific cases;Normative analysis, which emphasizes taking legal norms as the core and understanding the meaning, existence and operation mode of legal norms in cases;Contradiction analysis, focusing on revealing various conflicts in cases, understands the inevitability of the emergence and development of relevant laws and the unique role of laws;Critical analysis refers to the reflection on the rules and referees in the case, and the dialectical thinking on the possible shortcomings and improvement countermeasures. The application of case analysis method is restricted by case content, teaching purpose and teaching object.
