近年来网络产业依托我国对外开放、对内互通的利好政策飞速发展,而计算机算法作为信息互通、人机交互的媒介,伴随网络技术的发展而广为应用。智能化时代,算法背后所依托的更多是大数据和人工智能技术等新兴技术,而算法智能化也致使用户的数据安全,在数据采集、后台处理、服务推送等多环节中遭遇挑战。基于我国网络领域中的现状与问题,应当从公主体、私主体、国内、国际四个角度做好数据获取的监督审查、举证证明责任分配、行业自律、软硬件壁垒、国际司法协助等多方面内容,全面保护公民个人数据安全。

In recent years,the network industry has developed rapidly relying on China's favorable policy.Computer algorithm,as the medium of information exchange and human-computer interaction,is also widely used with the development of network technology.In the era of intelligence,the algorithm relies more on the big data and artificial intelligence.But the intelligent of the algorithm also causes the user's data security to face challenges,by data collection,background processing,service push and so on.Based on the current situation and problems in Chinas network,supervision and review of data acquisition,the distribution of burden of proofs industry self-discipline,software and hardware barriers,international judicial assistance and other methods need to be done to protect the security of citizens*personal data comprehensively.
