“通知-删除”规则在ISP适用的困境与出路

The Dilemma and Solution of "Notice-and-Takedown" Rule in ISP Application

“通知-删除”规则平衡著作权人、网络服务提供者、网络用户三方利益,是ISP应遵守的法定义务。我国“通知-删除”规则存在ISP界定和分类不完善、合格通知性质不明晰、合格通知要件不准确、不合格通知后果不明确、不重视转通知程序和反通知程序等问题,存在ISP于网络服务协议中直接规定“不通知用户即可删除资料”的现象。因此,应完善ISP主体方面的规定;增加通知实质性符合要件时视为合格通知的规定;完善合格通知要件的表述;鼓励ISP在能力范围内自主创新,采取事前措施以减少不合格通知;修改转通知程序、反通知程序方面的规定。应注重平衡三方利益,不忽视用户利益,让ISP真正中立,促进网络环境的繁荣与发展。

The"notice-and-takedown"rule balances the interests of copyright owners,internet service pro‐viders(ISPs)and internet users,which is the legal obligation of ISP.There are some problems,such as the imper‐fect definition and classification of ISP,the unclear nature of qualified notice,the inaccurate elements of qualified notice,the unclear consequences of unqualified notice,and the ignorance of transfer notice and counter notice procedure.Some ISPs stipulate that"data can be deleted without notifying the user"in service agreement.It is necessary to improve the provisions of ISP subjects,add the situation of qualified notice and improve the expres‐sion of content elements,encourage competent ISPs to take prior measures to reduce unqualified notice,and mod‐ify the provisions on transfer notice and counter notice procedure.Pay attention to balance the interests of the three parties.Don't ignore the interests of users and make ISP neutral to promote the prosperity and development of the network environment.
