公共领域视角下著作权的扩张与限制研究

Research on the Expansion and Limitation of Copyright from the Perspective of Public Sphere

作为著作权中的重要理论,公共领域为读者提供了充足的阅读资源,也为创作者提供了无尽的创作土壤,对我国的文化繁荣发展起到了推动作用。但随着人们的版权意识提高和科技的迅猛发展,著作权不断进行扩张,著作权人滥用权利保护,形成一定程度的权利垄断,一定程度上挤占了公共领域的空间。本研究就此分析著作权不断扩张的原因及其危害,针对性地提出构建著作权公共领域的具体规范、规范相关的技术保护措施以及建立执法惩罚机制等建议,以期可以最大限度地平衡著作权人利益与社会公众的利益,从而更好地促进知识的传播、繁荣与发展。

As an important theory of copyright,the public sphere provides readers with sufficient reading resources and creators with endless soil for creation, which plays an important role in the cultural prosperity and development of China.However,with the improvement of people′s awareness of copyright and the rapid development of science and technology,copyright continues to expand.Copyright owners abuse their rights to protect, form a certain degree of right monopoly,occupying the space of the public domain to some extent.This paper analyzes the reasons for the continuous expansion of copyright and its harm.In order to maximize the balance between the interests of copyright owners and the interests of the public, and to promote the dissemination, prosperity and development of knowledge, this paper puts forward some suggestions on constructing the specific norms of the public domain of copyright,standardizing the relevant technical protection measures and establishing the law enforcement and punishment mechanism.
