突发公共卫生事件中行政强制措施适用问题分析

不同于常态下的疫情防控措施,突发公共卫生事件中的强制措施,尤其是行政强制措施的启动更为迅速,措施也更为有力,同样,其行为结果也必然会对行政相对人的权益造成更大影响,因而,突发公共卫生事件中行政强制措施适用理应纳入法治化轨道,加强规范和监督。

Compared with the normal epidemic prevention and control measures,compulsory measures in public health emergencies,especially administrative compulsory measures,are launched more quickly and more powerful.Similarly,their behavior results will inevitably have a greater impact on the rights and interests of administrative counterparts.Therefore,the application of administrative compulsory measures in public health emergencies should be brought into the track of rule of law to strengthen standardization and supervision.
