摘要
当前,秦岭文化遗产的整体性价值及保护需求尚未受到有效关注与实现,尤其是涉及文化遗产保护的法律法规的建设、实施绩效欠佳。秦岭文化遗产保护现状显示出整体性保护立法缺失,执法部门各自为政,地区间保护工作缺乏联动机制,公众参与原则落实不到位等问题。国家和相关地方应制定秦岭整体性保护立法,在立法中明确整体性保护原则,整合执法力量,进而通过建立联席会议及落实公众参与原则等方式,保障秦岭文化遗产的传承保护、创新发展,推动人与自然的和谐共生以及区域经济社会的可持续发展。
The current legal protection system on Qinling Mountains only focuses on the theme of ecological environment and fails to cover cultural heritage.By analyzing the status quo of cultural heritage protection on Qinling Mountains,the article clarifies that the crux of the current protection work lies on the separation of legislation,the dispersion of law enforcement,the lack of linkage mechanism for inter-regional protection work,and inadequate implementation of the principles of public participation.For solving all above problems from the root,It is recommended that the state and relevant places formulate Qinling holistic protection legislation,clarify the integral protection principles,integrate law enforcement forces,then establish joint meetings and implement the principles of public participation to ensure the inheritance,protection,innovation and development of the Qinling cultural heritage,so as to promote the harmonious coexistence between human with nature and sustainable development of economy and society.
