社会主义核心价值观融入《民法典》解释的意义和方法

The Importance and Methods of Incorporating the Core Socialist Values into the Interpretation of the Chinese Civil Code

基于立法者有限理性的假设、社会生活变动不居的客观事实和语言文字固有模糊性的难以根除,《民法典》不可能对未来发生的案件作出事无巨细的规定,《民法典》必然存在法律漏洞。作为《民法典》内在体系集中体现的社会主义核心价值观必然会对《民法典》的条文解释和漏洞填补发挥重要作用。在有规范性法律文件的案件中,无论是对该规范进行文义解释、体系解释、历史解释,还是目的解释,社会主义核心价值观可以起到增强说理的作用;在无规范性法律文件的案件中,社会主义核心价值观可以起到法律漏洞填补的作用。

Due to the assumption of the legislature’s bounded rationality, the changing way of life in the society, and the difficulties in removing the inherent ambiguity in the language, one cannot reasonably expect that the Chinese Civil Code has laid down detailed provisions to respond to all types of cases happening in the future. There are inevitably lacunae in the Chinese Civil Code. To be coherent with the internal system of the Chinese Civil Code, the Core Socialist Values shall play a vital role in assisting to interpret provisions and fill lacunae in the Chinese Civil Code. As to cases with sources of law to apply, the Core Socialist Values may have the function of enhancing the judge’s reasoning when citing the very sources of law, no matter the judge takes a textualist, systemic, historical, or teleological approach of legal interpretation. As to cases without any source of law to apply, the Core Socialist Values may have the function of filling the lacuna.
