一起违法从事动物诊疗活动案件的查处与思考

Investigation and Reflection on a Case of Illegal Animal Diagnosis and Treatment

A市农业农村局对C宠物医院涉嫌未取得动物诊疗许可证从事动物诊疗活动立案调查取证后,认定当事人违法事实清楚、证据确凿,依照《中华人民共和国动物防疫法》之规定,对当事人作出"没收违法所得365元并处罚款3000元"的行政处罚决定。本文对该案进行了分析,提出了做好农业系统内监管与处罚环节无缝对接,坚持执法与普法相结合,采用多样化人性化执法方式,完善农业农村部门与其他管理部门之间的衔接机制等发展思考。

It was determined that,by the bureau of agricultural and rural affairs of A city,after investigation into a suspected case of engaging in animal diagnosis and treatment activities without a permit by C pet hospital,the illegal facts made by the party concerned were clear with conclusive evidences,and an administrative penalty of"confiscating the illegal income of CNY 365 yuan and imposing a fine of CNY 3000 yuan"was imposed on the party concerned according to the provisions of Law of the People’s Republic of China on Animal Disease Prevention.In the paper,the case was analyzed,and efforts on seamless connection between supervision and punishment within agricultural system,combination of law enforcement and law popularization,application of diversified humanized methods for law enforcement,and improvement of the connection mechanism between agricultural and rural affairs departments and other authorities were considered.
