The System Paradigm of Legislation of Market Economy in China

我国市场经济立法存在市场规制强度失衡、共治权力分野失序、二元立法结构失调的体系性误区。系统论理念作为解剖我国40多年来经济立法系统沉疴的"手术刀",对于认识市场经济立法的变革具有重要意义。系统论在整体性思维指导下体现的三大系统性规律,动态稳定法则、有机整体原理、协调优化范式,对检讨和完善我国市场经济立法有所裨益。证券市场规制的变迁体现了市场监管强度的守恒规律,政府部分退出与嵌入式自我约束体现了市场调制主体的转化方式,刚柔相济规则的共生体现了管制与促进效能互补的思维。党的十九大明确"着力增强改革系统性、整体性、协同性"是历史改革取得重大突破的宝贵经验,系统性改革将是新时代市场经济立法深化改革的必然要求与强大动力。市场经济的立法应当借助系统论的理念来破解多年来市场规制、社会治理与立法结构困境,最终实现经济新常态下创新驱动的可持续发展,为经济整体高质量发展协调施力。在系统论指导下的中国市场经济立法发展,应当立足全面深化改革的系统论语境,革新与系统存续相悖的子系统,检讨依赖政府的畸形治理路径,均衡发展市场经济法律体系,纠偏倾向管制性规则的做法,双管齐下优化系统依赖的环境,以实现经济高质、有序、繁荣发展。

The idea of System Theory, as a “scalpel” for dissecting the malady of China’s economic legislation system for more than forty years, is of great significance to understand the reform of market economy legislation. Under the integrative thinking, the System Theory contains dynamic stabilization rule, organic integrity principle and coordinated optimization pattern, which benefits the improvement of Chinese market economy legislation. “Focusing on enhancing the systematicness, integrity and synergy of the reform”as specified at the 19 th National Congress of the Communist Party of China is the valuable experience of making a major breakthrough in the historical reform, and a systematic reform will be the inevitable requirement and powerful driving force for deepening the legislative reform of market economy in the new era.
