欧盟进出口商品检验鉴定机构监管与我国情况比较研究

Comparative Study on the Supervision of Institutions of Import&Export Commodity Inspection and Survey between EU and China

进出口商品检验鉴定机构独立开展检验鉴定工作,对推动国际贸易公平、促进国际贸易发展、保护消费者免受缺陷产品伤害发挥了积极作用。海关不断改进进出口商品检验鉴定机构的监管方式,推动进出口商品检验鉴定行业朝着规范化、科学化的方向发展。本文分析了欧盟进出口商品检验鉴定机构监管的法律法规、市场准入、监管方式及违规责任情况,并研究欧盟和我国进出口检验鉴定机构监管情况的差异,对我国进出口商品检验鉴定机构监管工作提出建设性建议。

Institutions of import&export commodity inspection and survey independently engage in import and export commodity inspection and testing,which has the function of maintaining international trade fairness,promoting international trade prosperity,and protecting consumers from defective products.In recent years,the customs has continuously innovated the supervision methods of institutions of import&export commodity inspection and survey,and promoted the standardized,institutionalized and scientific operation of the industry of import&export commodity inspection and survey.This article analyses the laws and regulations,market access,supervision and legal liability of institutions of import&export commodity inspection and survey in EU,and compares the differences between EU and China.Finally,it provides the constructive suggestions for the supervision of institutions of import&export commodity inspection and survey in China.
