How to Improve the Olympic AHD Arbitration System

文章运用法理分析奥运会AHD仲裁机制特点,指出一裁终局机制的存在缺陷,并提出AHD仲裁机制的优化和重构策略。研究认为:在仲裁机制上,一裁终局制度存在四种特点,即体育纠纷解决的及时性、AHD仲裁权力的垄断性、仲裁法规适用的依附性以及仲裁监督机制的软弱性。同时,其困境在于一裁终局制度难保仲裁程序和结果的公正,并且救济措施完全缺失。建议:在AHD仲裁机制的优化上,应坚持程序正义优先和制度信息公开原则,以及建立监督机制和责任追究制度;AHD仲裁机制的重构可采用二裁终局制,其中,一次裁决应坚持"公平保速度"原则,二次裁决应坚持"公平保质量"原则。

This paper analyses the characteristics of the arbitration mechanism of AHD with jurisprudence,points out the shortcomings of the final mechanism of the arbitration of AHD, and puts forward some measures to optimize and reconstruct the arbitration mechanism. The study holds that the final system has four characteristics in arbitration mechanism, namely, the timeliness of sports dispute settlement, the monopoly of the AHD arbitration power, the dependence of Arbitration Law Application and the weakness of arbitration supervision mechanism. At the same time, its predicament lies in the fact that the final adjudication system cannot guarantee the fairness of arbitration procedures and results, and relief measures are completely absent. It is suggested that in the optimization of AHD arbitration mechanism, we should adhere to the principle of procedural justice priority and system information disclosure, establish supervision mechanism and accountability system;the reconstruction of AHD arbitration mechanism can adopt binary final system, among them, the primary ruling should adhere to the principle of "fairness guarantees speed" and the second ruling should adhere to the principle of "fairness guarantees quality".
