从礼法分野与融合中寻求“软法”的适用方向---兼对酒驾人格权威治理转化的考论

Seeking The Applicable Direction of “Soft Law” from The Separation and Integrationof Etiquette and Law: Also a Study on The Transformationof Personality Authority Governing Drunk Driving

法治的本质是一种非人格化的治理方式。在我国司法实践中,形式法治与实质法治作为两种主流的法治理念,它们之间的冲突与整合是国家现代化法治建设过程中的常态化形式。现阶段,我国公民法治意识薄弱,社会治理方式的创新性不足,运用行政干预手段较多,单一的惩罚机制必然会存在更多的局限性。柔性方法是社会治理的助推器,在尚未形成“共建共享共治”的社会格局中,酒驾治理需要从运用单一的法律制裁手段转为综合的治理模式。全面推进依法治国的治理之道,需要实现法律“工具主义观”向“治理主义观”的基础转变。从“软法”与“硬法”互动结合的治理方式切入,分析古代社会“礼法结合”在现代的运用,为提升社会综合治理效能提供更多的借鉴意义,从而实现“柔性引导”与“硬性规制”的相互融合。

The essence of the rule of law is a non-personalized way of governance.In China s judicial practice,formal rule of law and substantive rule of law are two mainstream concepts of the rule of law.The conflict and integration between them is the normal form in the process of national modernization and the construction of the rule of law.At this stage,China s citizens awareness of the rule of law is weak,the innovation of social governance is insufficient,and there are more means of administrative intervention.A single punishment mechanism is bound to have more limitations.Flexible method is the booster of social governance.In the absence of a social pattern of“co construction,sharing and co governance”,drunk driving governance needs to change from a single legal sanction to a comprehensive governance model.To comprehensively promote the governance of the rule of law,we need to realize the basic transformation from the“instrumentalist view”of law to the“Governance View”.Starting from the governance mode of the interactive combination of“soft law”and“hard law”,this paper analyzes the modern application of the“combination of etiquette and law”in ancient society,provides more reference significance for improving the efficiency of comprehensive social governance,and realizes the integration of“flexible guidance”and“hard regulation”.
