内容平台电商化下的法律地位界定--以电商直播为研究对象

摘要 网络平台的主要类型有网络媒介平台和电子商务平台,前者就是我们常说的内容平台,比如抖音、微信、直播平台等,在法律中主要是一种“信息网络服务提供者”的身份,受到《民法典》侵权责任编的“红旗原则”和“避风港原则”规制;后者是日常熟知的淘宝、京东等电商平台,主要受到《电子商务法》《消费者权益保护法》等法律规制,两者之间有着清楚的界限。然而,随着时代的发展及科技的进步,许多内容平台开始电商化,在平台中开启商品橱窗,提供商品和服务,使得内容平台的身份变得复杂,难以找到准确的法条进行规制。所以,准确界定内容电商平台的法律地位,清晰应该承担的责任将变得十分必要。 The main types of network platforms are network media platform and e-commerce platform.The former is what people often call content platform,such as Douyin,Wechat,live broadcast platform and so on.In law,it is mainly a kind of identity of“information network service provider”.It is regulated by“red flag rule”and“safe harbor principle”compiled by Civil Code.The latter is the daily well-known e-commerce platforms such as Taobao and Jingdong which are mainly regulated by laws such as the E-commerce Law and the Consumer Protection Law.There is a clear boundary between the two.However,with the development of the times and the progress of science and technology,many content platforms begin to be e-commerce,opening commodity windows and providing goods and services in the platforms,which makes the identity of the content platform become complex,and it is difficult to find accurate laws to regulate.Therefore,it will become very necessary to accurately define the legal status of the content e-commerce platform and clarify the responsibilities that should be borne.
